Call for Tenders - third GSM and UMTS provider

Section 32, Subsection 8 Act on Electronic Communications "The Office shall publish the call for submission of bids pursuant to Section 6, Subsection 4 and in one national daily press periodical in the Slovak Republic"...  Call for Tenders

 

The Telecommunications Office of the Slovak Republic (hereinafter „Office“) as a state administration authority and the national regulator in the area of electronic communications pursuant to Article 6(1)(b), Article 6(3)(a), Article 11(1)(c) of Act No. 610/2003 Coll. on electronic communications as amended (hereinafter „Electronic Communications Act“) begins pursuant to Article 32(6)(7)(8) of the Electronic Communications Act and in accordance with resolution of the Government of the Slovak Republic No. 5 of 11 January 2006 on the policy of frequency spectrum use  

a tender procedure 

for the allocation of frequencies to set up and operate a public electronic communications network – GSM and UMTS mobile telephone network in the Slovak Republic for providing public electronic communications services in a mobile network

 

 

a)      Frequency blocks 

The subject of the tender procedure is the allocation of frequencies, or frequency blocks from the frequency bands GSM 900 MHz, GSM 1800 MHz, UMTS and FS 29 GHz, which are published on the Internet web site of the Office www.teleoff.gov.sk with the scope for the whole territory of the Slovak Republic, for a period of 20 years.

 

b)      Purpose of use, conditions, and principles for optimum use of frequencies 

The frequencies are designed for setting up and operating a GSM, UMTS and FS 29 GHz public mobile electronic communications network (hereinafter „mobile telephone network“) and for  providing a public mobile telephone service, date and multimedia services in line with General Permit No. VP 1/2005 as amended and in accordance with the Electronic Communications Act.

 

c)      Evaluation criteria 

The Selection Commission shall, pursuant to Article 32(15) of the Electronic Communications Act, exclude from the tender procedure a participant in case the participant: 

1. has a capital or personal connection to another participant in the tender procedure pursuant to this call for tenders 

2. does not meet any requirement relating to form and extent of the application and the tender according to this call for tenders 

3. does not fulfil any requirement for the content of the application and the tender according to this call for tenders 

4. does not fulfil the requirement of minimal one-off amount payment for the allocation of frequency blocks 

5. submits any declaration or statement in the course of the tender procedure which turns out to be false.

 

The Selection Commission shall, pursuant to Article 32(14) of the Electronic Communications Act, determine the ranking of participants in the tender procedure according to the following criteria: 

1. contribution of the participant to strengthening the competitive market in the area of electronic communications 

2. preparedness and time sequence of building the network and providing services 

3. experience of the participant with providing electronic communications services – GSM and UMTS mobile telephone networks  

4. extent of services provided in frequency blocks pursuant to this call for tenders 

5. offered amount of one-off payment for the allocation of frequency blocks

 

 

d) Deadline for application submission together with a tender 

An application together with a tender must be delivered to the Office not later than on 14 July 2006 by 13:30 hours, regardless of the way of delivery. An application together with a tender must be submitted at the filing room of the Office at the address: Telecommunications Office of the Slovak Republic, Továrenská 7, 810 06 Bratislava, or it can be sent by post in the form of a registered letter to the aforementioned address of the Office. The filing room is open every working day from 8:00 – 11:00 and 12:00 – 13:30 hours. 

Within the specified deadline it is possible to change the application with the tender, and an applicant can do so by submitting a new application with a tender. When a new application with a tender is submitted, the offer is delivered to the Office last will be considered.  

The Office will not consider an application with a tender delivered on 14 July 2006 after 13:30 hours.

 

e) Requirements for the form and content of presented documentation to ensure comparability of tenders 

Based on this call for tenders an applicant will submit, within the deadline stated in point d), to the Office an Application for the Allocation of Frequencies and a Tender with supplements.

 

Application for the Allocation of Frequencies 

An application for the allocation of frequencies must be written in Slovak, in accordance with the specimen stated in Annex No. 1 of this call for tenders (simultaneously published on the Internet web site of the Office www.teleoff.gov.sk) with the following supplement:

 

-          Legal entities will present the original or an authenticated copy of an excerpt from the Business Register, or a similar document issued by the pertinent authority in the country of registration of the applicant with an official translation to Slovak, not older than 3 months

-          Natural persons will present the original or an authenticated copy of a Trade License or a similar document issued by the pertinent authority in the country of registration of the applicant with certified translation to Slovak, not older than 3 months

 

Tender 

The tender must be drawn up in the following structure and content:

 

I. Form and extent of the tender 

The tender must be written in Slovak, in two printed copies and one copy in electronic form on a CD-ROM with files in a format compatible with products of MS Office or Adobe Reader. 

The maximum extent of the tender including supplements must not exceed 100 pages.  

An application with a tender pursuant to this call for tenders must be delivered to the Office in a closed package. The text on the package must state:

II. Content of the Tender 

The delivered tender must contain the following information:

 

1. A declaration of the applicant stating that

a) directly or indirectly, itself or through another person or on the basis of an agreement concluded with another person there is no capital or personal connection with a person that is a provider of mobile telephone network in the Slovak Republic;

b) it is not in any similar relation to persons that are directly or indirectly in capital or personal connection to a person that is a provider of mobile telephone network in the Slovak Republic. 

An applicant that is a provider of a mobile telephone network in the Slovak Republic or is in a relation pursuant to paragraph a) and b) with a provider of a mobile telephone network in the Slovak Republic will state in the declaration what connection there is with other providers of a mobile telephone network in the Slovak Republic.

 

2. Ownership relations of the applicant

- provide a list of persons with a capital or personal connection to the applicant together with the size/ratio of their share and capital or personal connections of the applicant to entities doing business in the area of electronic communications

 

3. Offered amount of one-off payment for the frequency blocks

- state the sum for the allocation of frequency blocks pursuant to this call for tenders in Slovak koruna.

 

4. Experience with providing electronic communications services – GSM and UMTS mobile telephone networks

a) Experience of the applicant, or persons stated in point II of paragraph 2 in the area of setting up and operating electronic communications networks and services – GSM and UMTS mobile telephone networks in the Slovak Republic and in other countries;

b) The number of countries in which the applicant or persons stated in point II paragraph 2 provide services through a GSM and /sk/Vyb.konania/Vyzva/2006/gsm-umts.html UMTS mobile telephone network (the applicant will also provide a list of these countries);

c) The number of active end users (SIM cards) in the mobile network of the applicant, or persons stated in point II paragraph 2 in individual countries.

 

5. Extent of services to be provided in frequency channels pursuant to this call for tenders

- specify future services to be provided to end users of the GSM and UMTS mobile telephone network

 

6. Preparedness and time sequence of building the network and providing services 

a) A timetable for building the GSM and UMTS mobile telephone network on the territory of the SR and for providing services using the allocated frequency channels pursuant to this call for tenders;

b) Preparedness of the applicant to build a network and provide electronic communications services using the GSM and UMTS mobile telephone network

 

Supplements to the tender:

-          Documents confirming statements in the tender (for example a written declarations of third parties pertaining to the level of preparedness of the applicant pursuant to point II paragraph 6 b) of the tender, concerning national roaming, shared infrastructure, how building the network is secured, usage of sale network, etc.)

-          Other documents at the consideration of the applicant, which can also be in English (such as technical specification of the network and devices)

 

Warning:

The Office can use all data stated in the tender of an applicant (in particular pursuant to points II paragraph 5 and II paragraph 6) for issuing a permit as commitments of the applicant pursuant to Article 32(19)(f) of the Electronic Communications Act.

 

f)    The amount of one-off remittance for the delimitation or allocation of  frequency blocks as an anticipated minimum bid 

The minimum bid for a one-off remittance for the allocation of frequency channels pursuant to this tender is SKK 100 000 000.- (in words: one-hundred-million Slovak koruna).

 

g)    Other documentation for the tender procedure 

All required documentation is stated in part e).
