The Telecommunications Office of the Slovak Republic (hereinafter "the Office"),
which under Section 6(1)(b) of Act no. 610/2003 (hyperlink)
Coll. on Electronic Communications ("the Electronic Communications Act"), as
amended, is a state administration
authority in the field of electronic communications, hereby invites tenders in
accordance with Section 32(6), (7) and (8) of the Electronic Communications Act
for the
allocation of a block of frequencies to establish and operate mobile
communications network services in the
The
objective of this tender procedure is the allocation of frequencies or a block
of frequencies in the band 872-876 MHz/917-921 MHz, covering the whole territory
of the
The
successful tenderer will be allocated one block of three radio channels
occupying a bandwidth of 3.75 MHz along with those channels with which they form
a single duplex pair, as defined in an annex to the frequency spectrum
utilization plan (no. FP/MS-10). This annex lays down the principal conditions
for using frequencies in the band 870-876 MHz/915-921 MHz in the
The
allocated block of frequencies is designated for the operation of a single
nationwide mobile communications network that is based on digital broadband
technology and provides a publicly accessible electronic communication service.
Responsibility for the planning of frequencies within the allocated band lies
with the licence holder, who is also responsible for complying with the
stipulated conditions at the state border, as defined in international
agreements.
Frequency 872.000-875.800 MHz
is designated for terminal equipment.
Frequency 917.000–920.800 MHz
is designated for base stations.
Frequencies 875.800-876 MHz
and 920.800-921 MHz are protected frequencies.
The duplex distance is 45
MHz.
The Office lays down a single
evaluation criterion, namely, the amount of the lump sum offered for the
allocation of the frequencies or frequency blocks. Bids are expected to be at
least SKK 30 000 000 (thirty million Slovak koruny).
The successful tenderer will
be whoever offers the highest lump sum and will become the only participant.
Should a bid include a discrepancy between the numerical amount and the amount
written out, the written out number shall apply. If no bid is the highest, the
Office shall invite those applicants who made equally high bids to increase
their offer and shall set the deadline by when they should submit it to the
Office.
The
applicant shall submit to the Office the application drafted in the Slovak
language and signed either by a person or persons authorized to act on behalf of
the applicant according to an entry in
the Commercial Register, Trade Licence
Register or similar register, stating their first name, last name and position,
or by another person authorized to act on behalf of the applicant on the basis
of a power of attorney or the delegation of a power. The signature(s) on the
application must be officially attested.
The application must include:
· the first name, last
name and address of the applicant, if a natural person; or the business name and
registered office, if a legal person; or the business name and place of
business, if an unincorporated business; and the identification number (IČO)
of the natural person or
legal person, if they have already been assigned one for the purpose of
carrying on another activity;
· the frequencies
requested and the demarcation of the envisaged territory;
· the purpose of the
frequencies and how they are to be used;
· the period for which
the applicant is seeking a frequency allocation;
· as an annex, the
original or an attested copy of the extract from the Commercial Register or
Trade Licence Register or similar register, or another similar document of the
applicant's registration issued by a competent state authority and including an
official translation into the Slovak language, which is not older than three
months;
· as an annex, the
original power of attorney or delegation of a power, including
the attested signature of the principal or delegating authority, where
the person who is to act for the applicant is not the person authorized to act
on their behalf according to an entry in the Commercial Register, Trade Licence
Register or other similar register.
The applicant shall also
submit to the Office the bid drafted in the Slovak language and signed either by
a person or persons authorized to act on behalf of the applicant according to
the entry from the Commercial Register, Trade Licence Register or similar
register, stating their first name, last name and position, or by another person
authorized to act on behalf of the applicant on the basis of a power of attorney
or the delegation of a power. The signature(s) on the bid must be officially
attested.
The
bid must be designated as a "Tender bid for the allocation of frequencies to
establish and operate a mobile communications network service in the
· the first name, last
name and address of the applicant, if a natural person; or the business name and
registered office, if a legal person; or the business name and place of
business, if an unincorporated business; and the identification number (IČO)
of the natural person or
legal person, if they have already been assigned one for the purpose of
carrying on another activity;
· the amount of the
lump-sum bid in Slovak koruny (expressed both numerically and in words);
· as an annex, the
original power of attorney or delegation of a power, including the attested
signature of the principal or the designating authority, in the event that an
authorized person other than the one who signed the application is to sign the
bid under a power of attorney or the delegation of a power.
An
applicant who does not meet all the conditions laid down in this invitation to
tender will be excluded from the tender
procedure.
The
application and bid must be placed in an envelope that is closed and sealed, or
otherwise protected against accidental opening. On the envelope there must
written the first name, last name and address of the applicant, if a natural
person; or the business name and registered office, if a legal person; or the
business name and place of business, if an unincorporated business; and there
must be the designation "Tender procedure 872–876 MHz/917-921 MHz – not to be
opened!".

application and offer must be delivered to the Office no later than 13:30 on 29
