Question:
     The new act on Postal services No. 324/2011 Coll. designates the activities of The  Regulatory Authority as the state administration body for performing state regulation of postal services. Could you specify which competencies and activities does the Office perform?

Answer:
     The Regulatory Authority in accordance with the Act No. 324/2011 Coll. on Postal Services and on Amendment of Certain Acts performs independently:
1. state regulation of postal services and postal payment service,
2. state supervision over the provision of postal services and postal payment service,
3. cooperates with regulation authorities of other countries in the area of postal services,
4. is a notification body in the area of state regulation of postal services in relation to bodies of the European Union and to relevant bodies of the member countries of the European Union and to relevant bodies of the member countries of the European Free Trade Association,
5 .the statistical surveys in the area of postal services,
6. other activites according to the Act.

Within the regulation of postal services the Regulatory Authority mainly:
1. issues the general authorisation for providing the postal services,
2. performs the registration of postal companies,
3. issues licensies for providing the universal postal service,
4. accepts postal terms and condiction of the universal postal service and tariffs of the universal postal service,
5. decides about amendment, expiration and revocation of license for providing the universal postal service,
6. decides about price regulation of universal service including the approval of charges for providing the universal postal service,
7. decides about interchangeable postal services,
8. decides about temporary change of terms and conditions for providing the postal service,
9. review the organizational and technical prerequisities of operating the public postal network,
10. determines the requirements for the universal postal service,
11. determines the standards of universal service quality.

Question:
     What are the condictions for providing of postal services, is a trade license necessary for this activity?

Answer:
     With the efficiency of the Act No. 324/2011 Coll. on Postal services the postal operators do not need a trade license for the providing of postal services under the Act No. 455/1991 Coll. on the Trades Licensing (The Trades Licensing Act) as amended. The providing of postal services is enterpreneuring according to the Act No. 324/2011 Coll. According to § 17 and § 18 of this Postal Act the Postal Regulatory Office issued the General Authorisation for providing postal services for each of natural persons and corporate entities. The requirement for their´s providing is the registration of each postal company in the Register of the Postal Operators, where a types of provided postal services are marked. The date of competence for providing postal service is various according to a provided type of postal service (§ 25 of this Act). The providing of the universal postal service is regulated by the licence mode.
